Terms and Conditions

Welcome to muzicata.store (“we”, “us”, “the Site”). By browsing the Site or placing an order, you agree to these Terms & Conditions.

1) What we sell

We provide custom digital music services, created to order based on the information you submit during checkout (the “Order Form”). These services may include:

  • custom song composition and production (instrumental + arrangement)

  • custom lyrics based on your description

  • vocals (male / female / no preference) when available for the chosen product

  • optional add-ons (e.g., expedited delivery, confidentiality, name mention, custom verse/phrase)

The exact deliverables depend on the product/pacakage you purchase and the options you select.

2) Ordering & customer responsibility

2.1. When placing an order, you are responsible for providing accurate, complete, and lawful information.
2.2. You confirm you have the right to share any names, phrases, or other content you submit and that doing so does not violate any third-party rights (privacy, copyright, trademark, etc.).
2.3. We may contact you by email to clarify details. If we do not receive required clarifications, delivery time may be affected.

3) Pricing, VAT & payments

3.1. All prices on muzicata.store are shown in RON and include VAT (where applicable), unless explicitly stated otherwise at checkout.
3.2. Add-ons (such as expedited delivery, confidentiality, “include name”, “custom verse/phrase”) are charged in addition to the base package, according to what you select.
3.3. Payment is processed through the checkout methods available on the Site. Your order enters production only after successful payment.

4) Delivery times & deadlines

4.1. Delivery times (e.g., Standard / Premium / Priority) are estimates and begin after:

  • payment is confirmed, and

  • we have received the necessary order information (and any clarifications, if requested).
    4.2. If you provide incomplete info or respond late to clarifying questions, delivery may take longer.
    4.3. Delivery is digital (via email and/or a download link). You must provide a valid delivery email address.

5) Revisions & feedback

5.1. Your product page may specify whether revisions are included. If revisions are included, they cover reasonable adjustments (e.g., minor lyric tweaks, tone/mood adjustments, timing of a phrase).
5.2. Revisions do not include creating a completely new song from scratch unless explicitly agreed.
5.3. Additional revisions or substantial changes may require an additional fee.

6) Personalized digital services: cancellations & refunds

Because the product is personalized and created specifically for you, cancellations and refunds are limited.

6.1. Before production starts:
If you contact us quickly and production has not started, we may cancel the order and refund it. (Processing fees may apply depending on the payment provider.)

6.2. After production starts:
Once work has started, the order is generally non-refundable, because resources/time are already committed to producing your custom content.

6.3. After delivery:
Digital delivery is considered fulfilled. Refunds are not provided once the final files have been delivered, except where required by applicable law.

6.4. If something is wrong:
If you receive the wrong file, a broken link, or a clear technical error, we will fix it or resend it at no cost.

7) Content rules (what we will not create)

We reserve the right to refuse or cancel orders that include content that is:

  • hateful, harassing, or discriminatory

  • violent or promoting harm

  • sexually explicit involving minors or any illegal content

  • content that infringes copyright/trademark rights

  • defamatory or intended to impersonate or deceive
    If we refuse an order before production starts, we will refund it. If refusal happens after production has started due to late-discovered violations, refunds may not be available.

8) Confidentiality & portfolio use

8.1. If you purchase the Confidentiality add-on, we will not publish your track (or identifiable details) in our portfolio or marketing.
8.2. If you do not purchase confidentiality, you grant us permission to use a short excerpt and/or the track in a portfolio page on muzicata.store for demonstration purposes. We will avoid including sensitive personal details where reasonably possible.

9) Copyright, license & usage rights

9.1. Upon full payment, you receive a personal-use license to use the delivered track for private purposes (gift, personal posting, personal memories).
9.2. Unless explicitly agreed in writing, you may not:

  • claim authorship/production credits

  • resell, sublicense, or mint as NFTs

  • distribute commercially (ads, paid releases, monetized streaming) under your name as the producer/composer
    9.3. If you need commercial rights (release on Spotify/Apple Music, monetization, ads, brand use), contact us before ordering to arrange a separate license.

10) Quality expectations (important)

Music is subjective. We aim to match the style/mood you choose, but:

  • exact resemblance to any particular artist, song, or copyrighted work is not guaranteed and is not provided

  • your input affects the result; vague instructions may lead to broader interpretation
    We do our best to create a cohesive track consistent with your selections and description.

11) Limitation of liability

To the maximum extent permitted by law:

  • we are not liable for indirect or consequential damages (lost profits, missed events, etc.)

  • our total liability relating to an order will not exceed the amount paid for that order

12) Changes to these Terms

We may update these Terms occasionally. The version in effect at the time you place your order applies to that order.
